These Terms of Use (“Agreement”) govern access to and use of the website operated by OZDSystems under the Tobchik brand and the products and services made available through the Website.

Any person who visits or uses the Website, creates an account or places an order through the Website is referred to as the “User”.

By using the Website, you agree to be subject to these Terms of Use. Purchases are additionally governed by the Distance Sales Agreement, Preliminary Information Form, Shipping & Returns Policy and other applicable policies.

2. Scope

These Terms govern the general conditions applicable to the use of the Tobchik Website, creation of user accounts, viewing products, use of personalisation options, placement of orders, submission of information or content by Users and use of other online services provided by Tobchik.

Where a product is purchased, the agreements and policies applicable to that purchase shall apply in addition to these Terms.

3. Acceptance of the Terms

Users agree to use the Website in accordance with applicable law, these Terms and other policies and conditions published by Tobchik.

Users confirm that information they provide through the Website is accurate, current and either belongs to them or may lawfully be provided by them.

4. User Accounts

Tobchik may allow or require Users to create an account in order to access certain features.

Users are responsible for ensuring that information provided when creating an account is accurate and current.

Users are responsible for maintaining the confidentiality of their account credentials and passwords. If a User becomes aware of unauthorised use of their account or another security breach, they should notify Tobchik as soon as reasonably possible.

Users are responsible for activities conducted through their accounts to the extent such responsibility may lawfully be attributed to them.

5. Permitted Use of the Website

The Tobchik Website may only be used for lawful purposes.

The following activities are prohibited:

Using the Website for unlawful or fraudulent purposes,
Impersonating another person or providing misleading information,
Attempting to bypass or compromise Website security,
Transmitting malware, viruses or malicious code,
Placing an abnormal or excessive load on the Website infrastructure,
Collecting data without authorisation or using unauthorised automated scraping methods,
Interfering with another User's use of the Website,
Infringing intellectual property or other third-party rights,
Engaging in any other activity prohibited by applicable law.

6. Product Information

Tobchik takes reasonable care to ensure that product descriptions, images, prices and other information displayed on the Website are accurate and current.

Product colours may nevertheless appear slightly different depending on the User's screen or device settings.

Handmade products and products incorporating materials with natural variations may contain minor differences in colour, texture, dimensions, placement or craftsmanship that do not affect their essential characteristics.

Nothing in this section limits any statutory rights relating to defective or non-conforming products.

7. Prices

Current product prices are displayed on the Website. Applicable taxes are shown in accordance with applicable legislation.

Any applicable shipping or additional charges are disclosed before the order is completed.

Where an obvious technical or typographical error causes a price to be displayed materially differently from the actual sales price, the User will be informed and the matter will be handled in accordance with applicable law.

Subject to mandatory consumer rights, Tobchik may change the prices of products that have not yet been ordered.

8. Orders

Before completing an order, Users are responsible for reviewing the product information, personalisation options, delivery address and payment details.

The formation, processing, payment, delivery and withdrawal rules applicable to an order are further governed by the Preliminary Information Form and Distance Sales Agreement.

Tobchik will not arbitrarily cancel a confirmed consumer order without a legally valid reason. All mandatory consumer rights remain reserved.

9. Personalised Products

Certain Tobchik products may be personalised with a name, pet name, custom text, measurements, colour or other options.

Users are responsible for the accuracy of information submitted for personalisation.

Where an incorrect name, measurement or other personalisation detail has been provided by the User and the product has been manufactured correctly according to that information, this will not by itself constitute a manufacturing error attributable to the Seller.

The cancellation, withdrawal and return rules applicable to personalised products are explained in the Distance Sales Agreement and Shipping & Returns Policy.

10. User-Provided Content

Users confirm that they have all rights and permissions necessary to use and provide any text, name, image, design or other content submitted through personalisation fields, order notes, reviews, messages or other areas of the Website.

Users must not submit content that:

Is unlawful,
Infringes intellectual or industrial property rights of another person,
Infringes another person's privacy or personality rights,
Contains unlawful threats, hate speech or discrimination,
Constitutes or encourages criminal activity,
Contains another person's personal data unlawfully.

Tobchik may refuse personalisation requests that it reasonably considers unlawful or likely to infringe third-party rights.

11. Use of Personalisation Content

The User permits OZDSystems to use personalisation content submitted in connection with an order only to the extent necessary to manufacture and deliver the order, provide customer support and comply with applicable legal obligations.

Content submitted by the User will not be used for advertising or promotional purposes unless an additional permission or another valid legal basis exists.

12. Payment

Payments are made through payment methods offered on the Website.

Where payments are processed by a third-party payment service provider, the relevant provider's terms and security requirements may also apply.

Where fraud or an unauthorised transaction is reasonably suspected, Tobchik may request additional information for verification or review the transaction in accordance with applicable law.

13. Shipping, Returns and Withdrawal

Detailed terms relating to delivery, cancellations, exchanges, returns, the statutory right of withdrawal and exceptions applicable to personalised products are set out in the Shipping & Returns Policy, Preliminary Information Form and Distance Sales Agreement.

Nothing in these Terms removes or limits statutory consumer rights relating to withdrawal, defective goods, refunds or other mandatory protections.

14. Intellectual and Industrial Property Rights

Unless expressly stated otherwise, intellectual and industrial property rights relating to the Tobchik name, brand, logo, Website design, product photographs, graphics, text, designs, product presentations and other Website content belong to OZDSystems or the relevant rights holder.

Such content may not be copied, reproduced, published, distributed, modified, sold or otherwise commercially used without prior written permission from the relevant rights holder.

Ordinary viewing of the Website for personal and non-commercial purposes does not constitute a breach of this provision.

15. Use of the Tobchik Brand

The Tobchik name, logo and other brand identifiers may not be commercially used by third parties without prior written permission from OZDSystems or the relevant rights holder.

Nothing in these Terms grants the User any licence, ownership interest or other right in the Tobchik brand.

16. Third-Party Services and Links

The Website may contain links to payment providers, shipping companies, social media platforms or other third-party websites and services.

Third-party services are subject to their own terms of use and privacy policies.

Except where liability is imposed by law, OZDSystems is not responsible for the content, security or operation of independent third-party services outside its control.

17. Website Availability

OZDSystems uses reasonable efforts to maintain the availability and security of the Website.

Temporary interruptions may occur due to maintenance, updates, technical failures, infrastructure problems, cyberattacks, internet interruptions or other circumstances outside OZDSystems' reasonable control.

Such interruptions do not affect statutory rights relating to completed orders or consumer transactions.

18. Security

Users must not engage in conduct that compromises Website security or interferes with the normal operation of the system.

Unauthorised access, creation or exploitation of vulnerabilities, unauthorised security testing, transmission of malicious software and similar activities are prohibited.

Tobchik may implement reasonable technical and organisational measures to protect the Website and its Users.

19. Limitation of Liability

To the extent permitted by applicable law, OZDSystems will not be responsible for interruptions or losses resulting from internet connection failures, third-party system failures, problems with the User's own device or force majeure events outside its reasonable control.

Nothing in this provision limits liability arising from OZDSystems' intentional misconduct or gross negligence, statutory liability for defective goods or mandatory consumer rights.

Nothing in these Terms shall be interpreted as excluding or limiting a consumer right that cannot lawfully be excluded or restricted.

20. Suspension or Termination of Access

Where a User seriously breaches these Terms, applicable law or Website security requirements, Tobchik may temporarily or permanently restrict access to the Website or the relevant User account where such action is necessary and proportionate.

Such action does not remove any statutory rights relating to orders already completed by the User.

21. Personal Data

Personal data is processed in accordance with Turkish Personal Data Protection Law No. 6698 and other applicable legislation.

22. Changes to These Terms

OZDSystems may update these Terms to reflect changes in legislation, services, security requirements or its business operations.

Updated Terms become effective when published on the Website.

Changes made after a consumer contract has been concluded will not retroactively alter rights arising from previously completed orders to the detriment of the User.

23. Dispute Resolution

Consumer disputes may be submitted to the competent Consumer Arbitration Committee or Consumer Court in accordance with the applicable monetary thresholds and other requirements under Turkish consumer legislation.

The consumer's right to apply to the competent authorities at their place of residence or the place where the consumer transaction was carried out remains reserved.

An attempt by the parties to resolve a dispute through direct communication does not prevent the User from exercising any statutory remedy.

24. Governing Law

These Terms are governed by the laws of the Republic of Turkey.

Any mandatory consumer rights available to Users under applicable consumer protection legislation remain unaffected.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid provision shall, to the extent permitted by applicable law, be interpreted in a manner that most closely reflects its intended purpose.

27. Effective Date

These Terms become effective on the date they are published on the Website.

By continuing to use the Tobchik Website, the User agrees to be subject to the Terms of Use currently in effect.
